David Hart is a US Marine veteran who has suffered at the hands of the VA. He is a microcosm of the myriad of people who need help that the government appears unwilling to give. We have a duty to take care of our military men and women.
David Hart earned several meritorious service awards during his service in the United States Marine Corps from 1981-1985. But today he is in bad physical shape, due to mishandling and misdiagnosis by the VA. After reading his paperwork and listening to his story, it appears that this is a tragic example of inattention and bureaucratic mistakes that could ultimately cost this man his life.
The United States Marine Corps motto is “Semper Fidelis” – always faithful. The lack of respect and honor given to this US Marine and many more veterans like him has caused shakeups within the Department of Veterans Affairs. But until we have an “Always Faithful” attitude within the VAMCs around the nation, more and more veterans will suffer. It’s not about the job description, it’s about being faithful to the men and women of the United States Military. In David’s case, as in the case of so many others, bureaucratic red tape, incompetence, malpractice, and plain old fashioned lack of caring have left him — a Dead Marine Walking.

 May 2014 James meets with State Rep  Michelle Tyson-March where she tells James she feels he was “low-balled” in the decision given to him by the VA for his disability rating the previous year. -21 JULY 2014     James goes to VA hospital for neurosurgery consult that was rescheduled on behalf of VA from January. A neck stretching apparatus is prescribed and a follow-up is scheduled.
-21 JULY 2014 James’ records were obtained only to discover errors in his progress notes made by psychiatrist (who sees him regularly and described him as a white male, and she normally notes him as Hispanic) and a nurse practioner (who made statements that were never spoken in James’ admittance to the ER for a panic attack and severe chest pains).
-21 JULY 2014     James sought help from the BEACON team to make corrections to notes and Dr. Esser is called to assist James in making and addendum to the incorrect notes in his records. -24 JULY 2014    James is discharged from Ward 7 even though he is still feeling sick.
-25 JULY 2014 Phone calls are made on James’ behalf to seek further treatment at a more capable facility. Psychiatrist states all she can offer is other medication and if James is truly in danger of self-harm or homicidal ideations to take him to the ER or call 911 (Recording “Davidson”).
-30 JULY 2014 Contact is finally made with Deputy Alan Martinez via phone call upon his receipt of e-mail (see attached document Dep Alan Martinez) notifying him of James’ current situation.
-01 August 2014     Deputy Martinez says he is on the way to the VA in the morning to check on James’ situation and he will call later with his findings and he never does ( Recording “Friday Call” supports this).
-04 August 2014     Deputy Martinez is contacted to obtain a report of findings from Friday, only to be told that they’re still trying to find the claim; several hours later, Deputy Martinez calls to report that a “hard copy” of the claim was in fact filed, but that there must have been a mistake filing it electronically (Recordings “August 4 A,B,C,D”).
-05 August 2014    Deputy Martinez calls while meeting with head of mental health at UNM (Michael Maestas) to notify of plans for treatment at UNM (Recording “Maestas”).
-05 August 2014    James is taken involuntarily by a police officer to UNM; Staff was unaware of treatment plan and James is told by a Dr. Moss that he “cannot afford treatment” at UNM and he will be transferred back to Ward 7 at the VA. Deputy Martinez is notified of this and is consistently assuring that “James is to be nowhere near Ward 7, or the VA” (Recordings UNM 1,2,3,4).
-05 August 2014    James is transferred to VA via ambulance because UNM staff deems him incapable of making decisions for himself (see Progress Notes ).
-05 August 2014     James is admitted to Ward 7 under the conditions that it will only be over night while waiting for his transfer back to UNM. James is informed of a meeting held by the director of Ward 7, whose name is James, by a tech on Ward 7, by the name of Anita, that the staff has been alerted of James’ posts regarding Ward 7 on social media, and for them “to be careful,” because they were “being watched” and that another worker became upset to which Anita asked “Why? Everything he’s saying is true.”
-06 August 2014      Deputy Martinez is contacted to obtain update on James’ transfer to which he replies that UNM mental health will be contracted for treatment (Recording “Treatment Plan”).
-07 August 2014     Deputy Martinez calls with information regarding a meeting in Roswell, NM that consisted of several VIP in mental health as well as a congressman who were all made aware of the situation in Ward 7, as well as the overall situation with James. Deputy Martinez also says that a contract is being developed for James to receive proper care that he needs and deserves, and he wanted James to help develop this care plan so that other veterans may benefit from it until conditions in Ward 7 could be properly addressed and fixed.
-08 August 2014       Deputy Martinez meets with James to discuss treatment plan. Deputy Martinez doesn’t mention a transfer to UNM, and James is still under the impression he has a pending transfer. However, after speaking with Deputy Martinez via text, it is clear that no transfer is pending because Deputy Martinez states, “He wants to stay at the VA.” (See text messages and progress notes).
-08 August 2014        James checks himself out of Ward 7. Deputy Martinez is notified of this and makes no communication.
-11 August 2014      James is admitted to Presbyterian ER.
– 15 August 2014     James meets with NMDVS Representative Jeff George to discuss his claim. Jeff George states that the claim was not “lost,” it was never put in the system because it was “locked in [Michelle Tyson-March’s] office.”  He also states that at the fault of the VA, the claim cannot be back-dated. James asks Jeff George to represent him and bring attention to the mistakes continuously made by the VA to which Jeff George states he cannot for fear of losing his job, but he does write a letter to Governor Susana Martinez on behalf of James to request a back date of his claim increase. 17 August 2014       James sends Deputy Martinez a link to the video of the recording of the meeting with Jeff George, and Deputy Martinez requests a meeting with James and Jeff George for the 19th of August, 2014 (see text messages).
19 August 2014       Deputy Martinez holds a meeting with James to discuss the meeting with Jeff George, his increase claim, and treatment plan (Recording 19 August 2014).
20 August 2014         James receives a letter asking James to fill out a form 21-526EZ for documentation to process James’ increase claim, although Deputy Martinez told James his claim was already filed and being worked on.
25 August 2014            Deputy Martinez is informed of the letter and tells James he received the letter due to an electronic filing error.
12 September 2014       Deputy Martinez is contacted to obtain information regarding  James’ treatment plan because after three weeks of having checked himself out of Ward 7, James was still not contacted to begin his treatment. Deputy Martinez is confused and unable to answer any inquiries.
17  September 2014       James calls Deputy Martinez to discuss his treatment plan. Deputy Martinez says he will work on getting the VA to pay a TRE and Thai Chi specialist  James has been seeing for her services for James’ therapy. Deputy Martinez also agrees with James that Jeff George did not represent him well and that he lied to James in the meeting on 15 August, 2015.

Veteran runs into problems with VA after moving to Colorado

DENVER — A military veteran moved to Colorado because marijuana helped
him cope with serious PTSD. But a VA ruling may leave him far short of
benefits. This is why we as Veterans and Family should stand together and stand up. This is one out of many Veterans being treated like this.

 

Everyday we salute our veterans: Past, present, old, young, those who served in combat and those who have not.

Each and every one of them answered the call to defend freedom at all costs to benefit something larger than themselves; the greater good of the United States of America.

There are currently over 20 million veterans in America. Each one has a story, has family, and friends. Each with hopes and aspirations for the future. Each put them on hold to defend the Red, White, and Blue.

President John F. Kennedy once said on Veterans Day, “As we express our gratitude, we must never forget that our highest appreciation is not to utter words, but to live by them.”

Our veterans deserve better than what they are currently facing.

How do we thank our veterans?

Not with a handshake or a hug, but with a population that understands their sacrifices do not come without a price and by ensuring that all of our nation’s heroes receive the proper care and benefits they deserve when they come home from war and transition back into civilian life.

That means not having to suffer through the bureaucratic disarray of the Department of Veterans Affairs or trying to find work in an unstable economy where post 9/11 veterans faced 10.1% unemployment in September.

It means that our nation and government have our veterans best interest as their priority. Our veterans deserve better than what they are currently facing.

Instead, veterans were recently locked out of their war memorials that they fought for, that their friends died for.

They were told that their benefits checks would not go out during the partial government shutdown.

Death gratuity benefits were initially denied to grieving families of those who had paid the ultimate sacrifice.

Many veterans are struggling to find work as unemployment for post 9/11 veterans has consistently been in the double digits in recent months.

Some employers are apprehensive about hiring veterans because of the outrageous PTSD stereotype that follows our modern vets due to the false stigma about PTSD in the media and Hollywood.

On average, 22 veterans commit suicide every single day.

The Department of Veterans Affairs data shows that more than one third of new mental health care patients have to wait more than the standard of 14 days to receive an appointment. And in some instances, veterans have to wait more than a month to receive care.

The VA has the funding, the assets, and the personnel to prevent this from happening, but instead our veterans are not receiving the adequate care they deserve.

The VA claims backlog is still out of control.

Hundreds of thousands of veterans have to wait well over a year to receive an answer on the decision of their enrollment eligibility for a first time claim. And follow-on claims or disputed claims can take years to receive an answer.

The VA is not performing as the service oriented department it was intended for. Instead veterans are suffering the stresses and hassles of a dysfunctional bureaucracy.

This is not the environment or the treatment that veterans deserve to come home to after putting their life on the line day in and day out.

If we allow this to continue, what does this say about us as a nation? Are we are so willing to look past the current status quo of our veterans?

Right now there are still 54,500 US troops fighting the war in Afghanistan. That’s 54,500 people who are missing their families, missing their way of life and missing the freedoms that we as Americans get to enjoy each and everyday.

And you can bet that every time they wake up and strap on their boots before heading out on a patrol, a raid, a convoy or a flight that they remember why they chose to fight for freedoms and liberties that make this nation extraordinary.

Because it’s those who have answered the call to serve, those who are willing to sacrifice, and those that believe our nation should be handed down to future generations as we found it, they are the ones who truly understand the price of freedom.

This freedom that we have grown so accustomed to, that many take for granted in their everyday lives, is a privilege, not a right, which must be preserved.

It is bigger than you and me.

It is a vision of hope, opportunity, and prosperity.

It is fragile, yet resilient and will be defended at all costs.

Our veterans are our nation’s heroes. They stepped up to fight our nation’s wars without question or doubt.

They don’t ask to be paid as much as politicians or NFL players or to be Hollywood celebrities. Instead, they believe in their hearts that our unique nation, the United States of America, is not only worth fighting for, but worth dying for.

They believe the freedoms and liberties that make it exceptional are worth preserving at all costs. They ask for very little, if anything in return for putting their lives on the line.

They understand that they are contributing to the greater good for the sake of our future. The least we can do to show our appreciation is demand that our veterans are being taken care of when they come home.

So this Veterans Day think of what you can do to make our nation a better place here on the home front.

There is still plenty of work to be done. Because if you really want to thank our veterans for their sacrifices, their service to our nation, and for their dedication, we can do so by ensuring they are coming home to the America they fought for and that many died for.

It is because of them that we are able to enjoy the freedoms and liberties that we have grown so fond of.

It is because of them every American has the opportunity to pursue the American Dream. The Problem is the Current Income Tax Code

A. The current tax code is unfair, costly, and unreasonably confusing:

  • Because the tax code is so complex and easy to evade, many of us pay more in taxes year than we should! The I.R.S. estimates that over 40% of Americans no longer comply with the current tax code! This makes the rest of us pay over 30% more in taxes.·
  • Over half of American taxpayers seek professional help in preparing their income tax returns and, according to Money Magazine, chances are 99% that taxpayers will pay someone to file an incorrect return!·
  • Compliance with the tax code is not only very difficult and complicated but unreasonably expensive as well. It is estimated that it costs taxpayers $340 billion for tax filing, tax record keeping and tax reduction advice. That’s equivalent to about 3 million people working full time! B. The current income tax code unfairly hampers personal financial opportunity:

  • Since citizens are taxed on their earnings and on what they produce, hard work and risk-taking are discouraged.
  • The current income tax code inhibits economic growth, capital formation and, most importantly, job creation.
  • The current income tax code punishes personal savings and investments; and sometimes these are unfairly subjected to double and even triple taxation.

C. The current income tax code tax is grossly unfair to all wage-earning Americans:

  • Payroll taxes are taken out of our paychecks and we all have no control or choice over when we pay or how much we pay in taxes. Taxes are deducted from our paychecks before we can save or spend it.
  • The payroll tax is the most regressive and unfair feature of our current tax system.
  • The current payroll tax applies only to wages and hurts the most important tool by which anyone who is not born to wealth has to get ahead.

D. The current tax system is manipulated by politicians. lobbyists and other special interest:

  • The complexity of the current income tax code is an open invitation to those with the means to manipulate the tax code.
  • There are more lobbyists registered in Washington D.C. for taxes than for any other issue.
